These Terms of Service apply when you create an FPS.ms account, use the FPS.ms panel, deploy servers, run containers or apps, use webhosting, manage DNS or domains, use email-related services, top up account balance, contact support, or otherwise use our services. By creating an account, accepting these Terms in the panel, deploying a service, or continuing to use FPS.ms after a required legal update, you agree to these Terms and to the policies linked from them.
1. Related Policies
The following documents are part of your agreement with FPS.ms: If there is a conflict between these Terms and a service-specific rule shown during checkout or in the panel, the more specific rule applies for that service.2. Accounts and Eligibility
You must be at least 13 years old to use FPS.ms. If you are under 18, you may use FPS.ms only with permission from a parent or legal guardian. Paid services, top-ups, domain registrations, and any transaction that creates a payment obligation require permission from a parent or legal guardian if you are under 18. You must provide accurate account, billing, contact, and verification information. You must keep that information up to date. We may require email verification, credit card verification, phone verification, address verification, anti-abuse checks, or additional information before allowing access to services, paid features, domain registration, account recovery, or support actions. You are responsible for your account, API keys, SSH keys, passwords, linked accounts, teams, subusers, and anyone you allow to access your services. Do not share access with people you do not trust. Actions performed through your account or services are treated as your responsibility. You may not create or use multiple accounts to bypass free-plan limits, abuse controls, suspensions, verification requirements, or any other FPS.ms restriction. Multi-accounting and account networks are covered in more detail in the Acceptable Use Policy.3. Services We Provide
FPS.ms provides self-managed hosting infrastructure and related tools. Depending on the products available to your account, this may include game servers, generic containers, app hosting, webhosting, databases, backups, snapshots, DNS, DDNS, domains, email-related features, GitHub deployment tools, public URLs, proxies, support, and other panel features. Unless we explicitly agree otherwise in writing, FPS.ms is not a managed services provider. You are responsible for configuring, securing, updating, maintaining, and backing up the software, content, code, plugins, mods, databases, websites, apps, domains, DNS records, email accounts, and other resources you run on FPS.ms. We may add, change, suspend, remove, or limit services, products, plans, features, locations, resources, prices, quotas, or integrations. Where a material change negatively affects a paid service you are actively using, we will try to provide reasonable notice unless urgent security, legal, abuse, operational, or supplier reasons require faster action.4. Free Services
Free services are provided at our discretion and are intended for fair, personal, non-abusive use. Free services may have stricter limits, renewal requirements, hibernation rules, resource controls and support limits than paid services. Free services may not be used for commercial purposes under any circumstance. We may downgrade, suspend, delete, reclaim, or stop offering free services where they are inactive, expired, misused, unsafe, uneconomical to provide, or otherwise outside the purpose of the free plan.5. Paid Services, Balance, and Billing
FPS.ms uses a prepaid balance model. You add balance first, then use that balance to pay for eligible services such as paid hosting plans, renewals, domains, and other products. Account balance is not a bank account, e-money product, cash deposit, loan, investment, or stored value that can be withdrawn for cash. It is a credit that can be used only for eligible FPS.ms services. Prices may be shown excluding or including VAT depending on the page, user type, and checkout context. Taxes, fees, exchange rates, crypto-network costs, payment-provider costs, and registry costs may apply. EU VAT and reverse-charge treatment depend on the billing details and VAT validation available at the time of the transaction. Paid services are prepaid unless the panel or a written agreement clearly says otherwise. If a service expires or cannot be renewed because your balance is too low, it may be suspended, downgraded, deleted, or made unavailable according to the product rules shown in the panel and documentation. Refunds, withdrawal rights, balance cash-outs, payment errors, chargebacks, suspension consequences, and account deletion consequences are governed by the Refund and Withdrawal Policy.6. Domains, DNS, Webhosting, and Third-Party Rules
Domain registration, transfer, renewal, contact management, WHOIS or RDAP data, DNSSEC, transfer lock, privacy features, and TLD-specific requirements may depend on registries, registrars, resellers, and other suppliers. You must provide accurate registrant and contact information and comply with registry and registrar rules. Domain orders are not guaranteed until the registry or registrar confirms completion. We may refuse, cancel, reverse, suspend, transfer, lock, or correct domain-related actions where required by registry rules, law, payment issues, abuse handling, inaccurate data, or supplier instruction. Some FPS.ms features depend on third-party providers, including payment processors, domain providers, email providers, DNS providers, verification providers, anti-abuse providers, analytics providers, AI providers, storage providers, and infrastructure suppliers. Their availability, rules, and decisions may affect your services.7. Acceptable Use
You must comply with the Acceptable Use Policy at all times. The AUP explains what you may not host, run, sell, distribute, automate, attack, scan, relay, proxy, mine, bypass, or otherwise do through FPS.ms. The AUP applies to all services, including free services, paid services, servers, containers, apps, websites, files, databases, DNS records, domains, email accounts, proxies, public URLs, GitHub deployments, teams, subusers, and traffic generated by your resources. We may act against AUP violations even where the violation was caused by your users, customers, players, team members, compromised code, leaked credentials, misconfiguration, or a third party using your service.8. Security, Monitoring, and Abuse Handling
We may monitor FPS.ms systems, accounts, services, traffic metadata, logs, console output, files, processes, network behavior, payment behavior, login behavior, and related signals to operate the service, prevent abuse, investigate incidents, enforce our policies, protect other users, comply with legal obligations, and secure our infrastructure. We use automated and manual abuse review, including our internal Guardian systems. Where necessary and proportionate, we may inspect files, logs, console output, process data, network signals, account information, payment signals, and service metadata. We may quarantine accounts or services, preserve evidence, place legal holds, restrict access, or report suspected illegal activity to authorities or affected providers. More detail on personal data handling is available in the Privacy Policy.9. Suspension and Termination
We may warn, rate-limit, disable features, block traffic, remove content, quarantine services, suspend services, suspend accounts, terminate services, terminate accounts, preserve evidence, or refuse future service where reasonably necessary to:- protect FPS.ms, other users, suppliers, networks, or the public;
- stop or investigate abuse, fraud, security risk, or illegal activity;
- enforce these Terms, the AUP, or another policy;
- comply with law, regulation, court order, authority request, registry instruction, payment-provider instruction, or supplier requirement;
- respond to unpaid amounts, chargebacks, payment disputes, incorrect billing data, or failed verification;
- prevent repeated or severe policy violations.
10. Data, Backups, and Loss
You are responsible for keeping backups of anything important. FPS.ms backups, snapshots, exports, redundancy, or restore tools are convenience features, not a promise that your data can always be recovered. You should keep independent backups outside FPS.ms for important files, databases, configuration, domains, DNS zones, emails, websites, worlds, code, and app data. We are not responsible for data loss caused by your actions, your users, expired services, suspended services, deleted services, misconfiguration, compromised accounts, software bugs in your code, third-party services, force majeure, abuse enforcement, or failures outside our reasonable control, except where mandatory law says otherwise.11. Support
Support availability depends on your plan, service type, workload, and the issue. Free plans may receive limited or no support. Paid support helps with FPS.ms infrastructure and panel-related issues, but does not make FPS.ms responsible for managing your server, code, game configuration, plugins, mods, websites, apps, databases, or third-party software. We may refuse support for abusive users, unsupported software, unsafe workloads, illegal activity, policy violations, custom code problems, unmanaged administration tasks, or cases that require access or changes we are not comfortable performing.12. Availability and High-Risk Use
FPS.ms does not provide a contractual SLA or service credits unless we separately agree in writing. Availability expectations, maintenance, exclusions, and high-risk-use limits are described in the Service Availability Statement. Do not use FPS.ms for life-safety systems, emergency services, critical infrastructure, medical systems, financial trading systems, industrial control systems, or any workload where downtime, data loss, latency, or service errors could cause serious harm.13. Liability
FPS.ms provides the services as-is and as-available. We do not promise uninterrupted service, error-free operation, perfect security, compatibility with your software, availability of third-party services, or recovery of lost data. FPS.ms is not liable for indirect damages, lost profits, lost revenue, lost business, lost data, reputational damage, replacement costs, third-party claims, or damage caused by downtime, DDoS attacks, service interruptions, security incidents, user misconfiguration, expired services, or abuse enforcement. Where FPS.ms is legally liable despite these limits, our total liability is limited to the amount you paid to FPS.ms for the affected service during the one month before the event giving rise to the claim, unless mandatory law requires a higher amount.14. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold FPS.ms harmless from claims, costs, damages, losses, fines, penalties, and expenses arising from your content, services, users, customers, players, account activity, breach of these Terms, breach of the AUP, violation of law, infringement of third-party rights, payment disputes, domain disputes, or misuse of FPS.ms.15. Changes to These Terms
We may update these Terms and related policies. If a change is material, we will try to notify users through the panel, email, changelog, documentation, or another reasonable channel before or when the change takes effect. For important legal updates, we may require you to accept the new version before continuing to use the panel or before making a payment.16. Governing Law and Contact
These Terms are governed by the laws of the Netherlands, unless mandatory consumer law gives you rights that cannot be changed by contract. Questions about these Terms can be sent to[email protected]. Abuse reports should be sent through the abuse process described in the Acceptable Use Policy.
